  1. Introduction
    Welcome to CatAlytics ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the CatAlytics application, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Service.

  1. Eligibility
    You must be at least 18 years old to use the Service. By using CatAlytics, you represent and warrant that you have the legal capacity to enter into a binding agreement under Australian law.

  2. Description of Service
    CatAlytics provides analytics, insights, and tools for social media performance tracking and content optimisation. Features may change over time, and we reserve the right to modify or discontinue any part of the Service without notice.

  3. User Accounts
    To access certain features, you may be required to create an account.

You agree to:

  • Provide accurate and complete information

  • Keep your login credentials secure

  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

  1. Acceptable Use
    You agree not to:

  • Use the Service for unlawful or fraudulent purposes

  • Interfere with or disrupt the Service or its infrastructure

  • Attempt to gain unauthorised access to systems or data

  • Reverse engineer, scrape, or extract data without permission

  • Use the Service in a way that breaches third-party platform terms (e.g. Instagram, TikTok)

  1. Data and Integrations
    CatAlytics may integrate with third-party platforms (such as social media networks). By connecting your accounts, you authorise us to access and process data in accordance with our Privacy Policy.

You acknowledge:

  • We are not responsible for third-party platform changes or outages

  • Data accuracy depends on third-party APIs and may not be guaranteed

  1. Intellectual Property
    All intellectual property in the Service, including software, branding, and content, is owned by or licensed to CatAlytics.

You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.

You must not reproduce, modify, or distribute any part of the Service without prior written consent.

  1. Fees and Payments
    Some features of CatAlytics may be provided on a paid basis.

By subscribing to a paid plan:

  • You agree to pay all applicable fees

  • Payments are non-refundable unless required by Australian Consumer Law

  • We may change pricing with reasonable notice

  1. Australian Consumer Law
    Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Where permitted by law, our liability is limited to:

  • Re-supplying the Service, or

  • Paying the cost of having the Service supplied again

  1. Disclaimers
    The Service is provided "as is" and "as available".

We do not guarantee:

  • Continuous, uninterrupted access

  • Accuracy or completeness of analytics data

  • Specific business outcomes or performance improvements

  1. Limitation of Liability
    To the maximum extent permitted by law, CatAlytics is not liable for any indirect, incidental, or consequential loss, including loss of profits, data, or business opportunities arising from your use of the Service.

  2. Termination
    We may suspend or terminate your access to the Service at any time if you breach these Terms.

You may stop using the Service at any time. Termination does not affect any accrued rights or obligations.

  1. Privacy
    Your use of the Service is also governed by our Privacy Policy, which outlines how we collect, use, and store personal data in accordance with the Privacy Act 1988 (Cth).

  2. Changes to Terms
    We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

  3. Governing Law
    These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales.
